Neighbour Disputes & Injunctions

Stand Your Ground
& Stay Civil

Neighbour disputes can be stressful, but maintaining civility and clarity is key to reaching a resolution. Whether you need to request or challenge an action, we assist in pre-action conduct by drafting clear, professional communications that outline your position while keeping negotiations constructive. Our goal is to help you assert your rights while minimising hostility, presenting your case accurately at every stage.

If legal action becomes necessary, we provide support in applying for or defending injunctions, ensuring all documentation is well-informed and properly structured. We also assist with enforcing or appealing injunctions when needed. From pre-action communications to addressing antisocial behaviour orders (ASBOs), we frame your preferred outcome in a logical and precise way that your opponent, or the Judge, will understand.

How we can help…

Applying for or defending Court injunctions

Injunctions are when a Court orders someone to do – or NOT do – something. Our first aim is to avoid injunctions becoming necessary. From outset we provide our clients with specific, tailored advocacy with a view to reaching a lasting agreement between parties. These clear, concise and complete written communications represent our clients’ positions, either before or after applications for injunctions are made.

When appropriate, we also help our clients find the right expert witnesses and other professionals to best support their position in Court.

Responding to injunction disputes

When disputes become contentious, tact, diplomacy and a cool head are essential. Receiving communications in these disputes can be stressful and upsetting. We are here to help you formulate the correct response each time, so that you have a clear, documented record of your position, as communicated to the other party.

Focused, considered responses go a long way to putting you back in control of unwelcome actions. As always, our first aim is to help you achieve the outcome you want without having to go to Court.

Enforcing and appealing injunctions

When an injunction has been granted, it is not unusual that one party wishes to appeal it – or even chooses to ignore the Court! As ever, our tailored, focused approach to communications is here to assist you in an appeal or enforcing the Court’s orders.

Antisocial behaviour orders (ASBOs)

Antisocial behaviour orders (ASBOs)

ASBOs have become a common part of life in the UK. Good record-keeping and a knowledge of your rights are essential in dealing with antisocial neighbours. We can guide you through the process of seeking ASBOs so that your applications are dealt with swiftly and efficiently.

Injunctions: asking someone to do / NOT do something

Case Study: Tea & Medals

Michael owns a tourist attraction with beautiful, ancestral gardens and great Tea Rooms. He created a Facebook page and paid Tom to keep it updated, always paying properly and on time. When his wife Lara asked to manage the page, Michael asked Tom for the passcodes. Tom had changed them refused to tell Michael, instead demanding £2,000 to allow him to edit his own Facebook page! The Police did not see it as a criminal matter. Michael was worried because internet law and Facebook rules can be very complex.

Michael engaged us. After three Pre-action conduct letters and two emails, Tom duly handed over the passcodes free of charge. Lara is doing a great job with the page and visitor numbers have increased. She has, of course, also changed the passcodes!
