Advocacy & Noting Briefs

Don’t raise
your voice,
improve your
argument.

~ Desmond Tutu

Advocacy, which can be spoken or written, is defined as:

“Any action that speaks in favour of, recommends, argues for a cause, supports or defends, or pleads on behalf of others.”

However, good Advocacy extends much further than the words used and the way they are delivered.

It is intended to be relevant, persuasive and, where appropriate, emotive. It should engage the heart and mind of the receiver and put them firmly into the mindset of the voice before them. They must clearly see the cool rationale while appreciating the passion. This is no sleight-of-hand. This is the embodiment of your case so purely that your audience breathes it.

How we can help…

Spoken Advocacy

I am an experienced County Court Advocate & Solicitors Agent, having a track record of excellent presentation in Courts and Tribunals. I have also been invited to present educational Qualifying Sessions at Middle Temple, my Inn of Court. I am well-organised, never intimidated and can think on my feet. I am a good interviewer and know what to ask – and not ask – a witness in any given situation. It has been noted that I put clients at ease and take a strong, in-depth interest in their case and circumstances.

Case Study:

Sticking to her guns (well, pen knives)

Jerry owns a growing Outdoor Sports brand. Among other things, she designs and imports pocket knives for camping and outdoor work. To her horror, her first large shipment was detained by Border Force, who asserted they were illegal to import. A discrepancy on her Customs Declaration by the Chinese manufacturer also weakened her position.

I assisted Jerry with focused, specific and calm communication with Border Force, over the phone and in writing. This in turn focused their efforts on correctly classifying Jerry’s goods and accepting that the discrepancy did not affect the legality of the shipment. The import was approved and sold out in 2 weeks.

Written Advocacy

It is essential that all written communications – and submissions – are accurate, relevant and persuasive. We aim to be thorough, complete and concise in all our written advocacy. As a reference, I have two academic works published online, both of which were independently assessed to “Distinction” standard.

Case Study:

As the smoke clears …

To add to his woes, (see the contract page) Rafa’s award-winning Salon suffered a fire. Crystal chandeliers, among other things, needed rescuing from soot, fire damage and the effects of thick smoke – not to mention all the water pumped into the salon by the heroic Fire Service!

He engaged a “Specialist Cleaning Firm” who took a £2,000 deposit for their services in advance. They sent 3 men in a Nissan Micra, with a bucket, sponge and a bottle of Fairy Liquid. Rafa sent them home. Their Head Office never replied to Rafa’s emails or calls.

He then engaged us. Focused written advocacy got him his money back. Rafa says he keeps my business card in his wallet.

Noting Briefs

It is always important to record events, conversations and outcomes accurately as “contemporaneous notes”. Whether at Trials, Court Hearings, Employment Tribunals, Disciplinary meetings or even sales negotiations, an accurate, timely report holds great value. At work, disciplinary matters should always be recorded in writing.

Making these communications complete, clear and easy to understand also assists your case going forward. It is not only an important record but often an “insurance policy” for future reference. In any circumstances, we are happy to attend such events to provide accurate Noting Briefs.
